Terms and Conditions

These terms govern your use of OndaPass and the purchase of tickets through the platform. Please read them before buying: by creating an account or completing a purchase you accept them.

1. Who we are

OndaPass is a digital ticketing and access validation platform operated by [Legal company name], a company incorporated in the Republic of Panama, with RUC [RUC] and registered address at [Address].

2. Acceptance

By creating an account, buying a ticket or using any OndaPass service you accept these Terms and the Privacy Policy. If you do not agree, do not use the platform.

To buy you must be of legal age or have permission from your parent or guardian.

3. OndaPass is an intermediary

OndaPass provides the technology for organizers to publish their events, sell tickets and control access. OndaPass does not organize, produce or control the events.

The organizer is solely responsible for their event: that it takes place, its content, safety, permits, capacity, admission conditions and the accuracy of the published information. Every event page shows who organizes it.

A ticket is a contract between you and the organizer. OndaPass acts as a sales agent and collects payment on the organizer's behalf.

4. Your account

You must provide accurate information and keep your password secret. You are responsible for what happens through your account.

You can buy without an account by giving your email. We may suspend accounts that breach these Terms, telling you why.

5. Purchases and prices

Prices are shown in balboas (B/.) or US dollars (USD), both legal tender in Panama.

Before paying you see the full breakdown: the ticket price set by the organizer, the service fee and any applicable taxes [Confirm whether 7% ITBMS applies and to which items].

While you complete payment we hold your tickets for a limited time; when it runs out they are released. Your purchase is confirmed when the payment gateway approves the payment and we email you the confirmation with your tickets.

The organizer may set a maximum number of tickets per purchase or per person.

6. Service fee

Each purchase includes a service fee for using the platform, always shown before you pay.

7. Payment methods

We accept payments with Yappy and with credit or debit cards through PagueloFacil. Each gateway processes the payment under its own terms; OndaPass never stores your full card number.

We may reject or cancel a purchase if we detect signs of fraud. Fees charged by your bank do not depend on OndaPass.

8. QR code tickets

Each ticket has a unique QR code that is validated only once at the door. After the first scan it is marked as used and any copy will be rejected.

Keep your code safe: do not post or share it. If someone else uses it first, they get in. You can save your tickets to Apple Wallet or Google Wallet and recover them under “Recover my tickets”.

9. Resale and transfer

Reselling tickets commercially or above face value is not allowed unless the organizer expressly authorizes it. Tickets resold or obtained in breach of these Terms may be cancelled without a refund.

You may give your ticket to someone else by handing over the code [Describe whether named transfers will be available on the platform]. The organizer may ask for ID at the entrance.

10. Cancellations, changes and refunds

If the organizer cancels the event, you are entitled to get the ticket price back. The organizer authorizes the refund and OndaPass processes it to the same payment method within [Number of business days].

If the event changes date, time or venue, your ticket remains valid for the new date. If you cannot attend, you can ask for a refund within [Request window] of the change notice.

Outside these cases purchases are not refundable, without prejudice to your rights under Law 45 of 2007 on consumer protection.

11. Acceptable use

When using OndaPass you agree not to:

  • Use bots or automated means to buy or hoard tickets.
  • Forge, copy or alter QR codes.
  • Impersonate someone else or use another person's payment methods without permission.
  • Try to break the platform's security or get around its limits.

12. Intellectual property

The OndaPass software, brand and design belong to [Legal company name]. Each event's images and texts belong to its organizer, who guarantees they have the rights to publish them.

13. Limitation of liability

OndaPass is not liable for how events are held, their quality or safety, for the acts of the organizer or third parties, or for failures of external services such as payment gateways or your internet provider.

To the extent the law allows, our liability for a purchase is limited to what you paid OndaPass for it. Nothing here limits the non-waivable rights granted to you by consumer protection law.

14. Changes to these Terms

We may update these Terms. We will publish the new version with its date and let you know about important changes. Each purchase is governed by the Terms in force when you made it.

15. Governing law and complaints

These Terms are governed by the laws of the Republic of Panama. If you have a problem, write to us first and we will look for a solution.

You may also contact Panama's consumer protection authority (ACODECO). Any dispute will be submitted to the courts of Panama City.
